Bolingbrook, Other Towns Plan to Refile Water Pipeline Lawsuit

Suit could be refiled this spring.

A partnership of five Will County towns isn't giving up its bid to take over an Illinois American Water (IAW) pipeline.

The Northern Will County Water Agency, which includes members Romeoville, Bolingbrook, Homer Glen, Lemont and Woodridge, will refile its eminent domain lawsuit this April, a lawyer representing the group told the Herald-News.

The lawsuit was originally filed after Illinois American rejected the water agency's offer to purchase the Bedford Park pipeline for $36.6 million. Attorney Jim Boan said it was withdrawn to address "procedural" issues.

The five towns began a bid to take over the pipeline on the grounds that Illinois American is gouging citizens on water prices.

The water agency claims the pipeline takeover would prevent Illinois American Water from continually hiking residents' water bills.

IAW claims the increases in water rates are the result of increases from other agencies, and the Northern Will County Water Agency is wasting taxpayer money on a costly and lengthy legal process and misrepresenting the facts.

Officials in Lemont, Woodridge and Romeoville have said only small portions of their communities are served by Illinois American Water and would be affected. 

To refile the suit, each municipality will have to approve a revised intergovernmental agreement.
