Prosecutors will be able to use a mountain of hearsay evidence, after the Appellate Court decided 14 statements from Drew Peterson’s last two wives can be considered in his murder trial.
The 14 statements supposedly spoken by Drew Peterson's dead third wife and missing fourth wife can be used against him at his murder trial. The Third District Appellate Court in Ottawa handed down its decision on the Peterson case Thursday. The matter has been under appeal since the day before Peterson’s murder trial was to start in July 2010. The appellate court declined to decide the matter, prompting Will County State’s Attorney James Glasgow to take the case to the Illinois Supreme Court. In November, the supreme court sent the case back to the appellate court and charged them with settling it. The Illinois Supreme Court is sending Drew Peterson’s case back to the appellate court and told the judges to figure it out themselves.
It looks like serial marrier and accused wife-killer Drew Peterson is going to be spending another Christmas in the clink as the state’s higher courts pass his case back and forth like a hot potato. In the latest development in the protracted prosecution of Peterson — who was arrested in May 2009 on charges he murdered his third wife, Kathleen Savio — the Illinois Supreme Court on Wednesday sent his case back to the Third District Appellate Court in Ottawa. Fifty-six page opinion says prosecution missed deadline to file appeal against former Bolingbrook cop when he is tried for murder of his third wife.
Whether or not Drew Peterson's dead third wife predicted he would kill her, or his missing fourth wife confided in a divorce attorney that he committed murder, the jury is not going to hear about it. The appellate court shot down a bid by prosecutors to use hearsay evidence against Peterson, a disgraced former Bolingbrook police sergeant charged with killing one wife and suspected by the state cops of having a hand in the death of another. Jailed for more than two years on murder charges, suspect learns he's not going anywhere, at least for the time being.
Accused wife-killer Drew Peterson’s latest plea to get out of jail again fell on deaf ears, as the appellate court shot it down last week and told him he’s not going anywhere. Jailed since May 2009 on charges he murdered his third wife, Kathleen Savio, Peterson, 57, has been waiting on the appellate court to return a decision on what hearsay evidence can be used against him at trial. The appellate court has been mulling over the matter for just shy of a year. The murder charge in the Savio case stemmed from the then-40-year-old woman’s death in March 2004. Drew Peterson's attorneys plan to file papers Monday morning to have their client sprung from jail while the appellate court figures out what it's doing.
Drew Peterson was all set to stand trial on charges he murdered his third wife when State's Attorney James Glasgow filed a last minute appeal of what hearsay evidence could be used against the disgraced former Bolingbrook cop. That was almost a year ago. The judges from the Third District Appellate Court still haven't made up their minds about the appeal and Peterson was been locked up all the while. And now he wants out. Peterson's legal team plans to file papers with the appellate court in Ottawa asking for the accused wife-killer to be freed while three judges mull over what to do with the prosecution appeal. Amen to that Watchful Eye! They also fail to remember how he had his buddy come over with a cell phone for him to use so that the police couldn't listen to his phone calls, and was writing notes and shredding them in a shredder so the police couldn't get them out of the garbage.
